Terms of use

Last updated:

These terms apply to your use of Mappifier: the apps for Android, iOS and desktop and the web app at app.mappifier.com. By creating an account or using Mappifier you accept them.

1. Who we are

Mappifier is provided by:

Sabllia Sàrl
Rue de la Mauguettaz 24, 1462 Yvonand, Switzerland
CHE-179.642.340
support@mappifier.com

“We” and “us” in these terms mean this company.

2. What Mappifier does

You enter two to five locations and, for each, a mode of travel and a maximum travel time. Mappifier computes the area that can be reached from each location and shows the area that can be reached from all of them.

The areas are estimates. They are computed from map and routing data of third parties and don’t take account of current traffic, roadworks, weather or your personal pace. Travel times for cycling in particular can be less accurate. Don’t rely on Mappifier for navigation, for emergencies or for decisions where an error could cause injury or significant loss. Check what matters to you before you act on a result.

3. Your account

You can look at the map and place locations without an account. To search, you need an account with a confirmed email address. You must be at least 16 years old, and old enough in your country to enter into this agreement. Give correct details, keep your sign-in details to yourself, and tell us if you think someone else is using your account. An account is for one person.

4. Locations and the free allowance

Usage is counted in locations. Every location in a search uses one, so a search with three locations uses three. Once a location has been counted, searching it again with the same mode of travel and the same travel time is free for 30 days; changing either counts as a new location. A search that finds no common area still counts. A search that fails doesn’t.

If someone shares a search with you, its locations are free for you for as long as they are free for that person.

Each account gets a number of free locations every calendar month; the app shows how many. The month is counted in Coordinated Universal Time (UTC). Free locations you don’t use expire at the end of the month. We may change the number of free locations for future months.

5. Buying locations

How it works. When your free locations are used up, you can buy packs of locations in the Android and iOS apps. The seller of record is the Apple App Store or Google Play, which shows the price, including taxes, before you buy, and which processes the payment under its own terms.

What you get. Bought locations are added to your account, usually within a few minutes. They are used after your free locations, work on every platform where you sign in with the same account, and don’t expire while your account exists. They have no cash value and can’t be transferred to another account or exchanged for money.

Right of withdrawal. Bought locations are digital content that is delivered immediately. By buying a pack you ask us to deliver it at once, and you acknowledge that, where the law gives you a right to withdraw from the purchase, you lose it once the locations have been added to your account.

Refunds. Refunds are handled by the store you bought from, under its refund policy. When a store refunds a pack, we remove its locations from your account. If you had already used some of them, your balance of bought locations becomes negative until you buy again; your free locations aren’t affected.

Deleting your account. If you delete your account, any bought locations you haven’t used are deleted with it and aren’t refunded.

6. What you may not do

You agree not to:

7. Your results and our rights

You may use the areas Mappifier shows you for your own private or internal business purposes.

The apps, the service and their content belong to us or to our licensors. We grant you a personal, non-exclusive, non-transferable right to use them under these terms. The map is based on data © OpenStreetMap contributors. Travel areas and address search are provided by HERE.

8. Availability and changes to the service

We work to keep Mappifier available, but we don’t promise that it will be available without interruption or free of errors. We may change, limit or end features, for example when a provider we depend on changes its service.

If we end Mappifier altogether, we will announce it in the app at least 30 days ahead where we reasonably can, so that you can use the locations you bought.

9. Liability

We are liable without limit for damage we cause intentionally or through gross negligence, and for injury to life, body or health. Beyond that, and as far as the law permits, we aren’t liable for slight negligence, for indirect or consequential loss such as lost profit, or for the acts of the third parties whose data and services Mappifier relies on.

Nothing in these terms limits rights that the law of your country of residence gives you as a consumer and that can’t be excluded by contract.

10. Ending the agreement

You can stop using Mappifier and delete your account at any time in the app.

We may suspend or close your account if you seriously or repeatedly break these terms. We will tell you why, unless the law forbids it or it would defeat the purpose of the measure. If we close your account without such a reason, we will refund the bought locations you haven’t used.

11. Changes to these terms

We may change these terms, for example when the service or the law changes. We announce significant changes in the app or by email at least 30 days before they take effect. If you keep using Mappifier after that, you accept the new terms. If you don’t agree, you can delete your account.

12. Applicable law and courts

These terms are governed by Swiss law, excluding its conflict-of-law rules. The courts at our registered office have jurisdiction. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may also bring proceedings before the courts there.

13. If you got the app from the Apple App Store

These terms are between you and us, not Apple. Apple isn’t responsible for the app or its content and has no obligation to provide maintenance or support for it. If the app fails to conform to a warranty that applies, you may notify Apple, and Apple will refund the purchase price of the app, if any; beyond that, Apple has no warranty obligation for the app. Apple isn’t responsible for addressing claims by you or by third parties about the app, including product liability claims, claims that the app fails to meet a legal requirement, consumer protection or privacy claims, and claims that the app infringes someone’s intellectual property rights.

You confirm that you aren’t located in a country that is subject to a U.S. government embargo or designated by it as a “terrorist supporting” country, and that you aren’t on a U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
